By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
All content published and made available on our Site is the property of BLACKBOX GAMING SYSTEMS PTY LTD and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition n of our Site.
The minimum age to use our Site, is 16 years old. By using this Site, users agree that they are over 16 years old. We do not assume any legal responsibility for false statements about age.
When you create an account on our Site, you agree to the following:
1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site. The following goods are available on our Site:
BGS Modular Console and PC Gaming Table;
BGS Tower Console Cavity;
BGS Standard Console Cavity;
BGS PC Tower Cavity and Trolley Unit; and
BGS Table Mats.
These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through the following method, unless alternative arrangements are made and agreed upon by both :
Designated Shipping Courier.
Please note, that due to COVID 19, many shipping companies are prioritizing the shipments andReceiving of emergency and necessary medical equipment. This could mean that your package may be withheld with the shipping company for an extended period of time which would lead to longer wait times and delays. We hope you understand, as this is something completely out of our control.
All our products will be shipped and delivered to Australian destinations through Big Post, who has partnered with a number of well known carriers. Any shipping overseas is currently planned to be carried out by well known international carriers such as FedEx and DHL.
All orders will be processed within 3 - 4 weeks (if within Australia) after receiving your order confirmation, depending on our manufacturer's existing commitments and available materials at the time. Manufacturing will occur on a regular basis, however based on product order numbers. Customers will be updated on their product status during the manufacturing stages.
We plan to provide normal and express shipping. Details will be updated here in Terms and Conditions once we have negotiated with our chosen shipping companies.
After processing your order and the manufacture of your product/s are completed, the shipping may take up to 7 business days (excluding weekends and holidays) to arrive at its final destination.
To pack every single order, we will use strong boxes with internal protection to guarantee safety through the shipping process. If you received a tracking number via email, it means that your order has been processed and shipped to the distribution facility. As soon as your tracking information changes from “On Its Way” to “In Transit”, you should received the product/s within two business, unless advised otherwise by the courier.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected.
Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays.
You will be required to pay for delivery charges in addition to the price for the goods you purchase.
If you purchase goods from us for delivery to a destination outside Australia your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information. If the product, due to innacurate address details etc. is returned to us due to Address Unknown or Customer Unknown, then any expenses relating to re shipping to the correct address etc. will be met by the customer.
By placing an order through the blackboxgamingsystems.com website you agree to the terms below. These policies are in place to ensure that you are fully aware of our refund and return methods and procedures. These policies are applicable to the country of origin, namely Australia.
14 Day Return Policy
We have a 14 day return policy. This means you have 14 days after receiving your order to request a return. To be eligible for a return, your item must be in the same (new) condition that you received it, unused, with original tags and product labelling and in its original (unopened) packaging. You’ll also need to provide the purchase receipt or other proof of purchase.

After being returned to us for inspection, the product assessment could take around 1-7 business days.
After that, you’ll receive a new product or we will refund the full amount. Items sent back to us without first requesting a return will not be accepted.
Damaged, Wrong Products and Other Issues
Please inspect your order upon receipt and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

We do not charge a restocking fee on returns.
Return Shipping Fee
The return shipping fee will only be met by BLACKBOX GAMING SYSTEMS PTY LTD if the reason for return has deemed to be our error or defective product/s. In all other return situations, the shipping fee will be met by the customer.
Refunds and Order Cancellations
If the product/s are still being processed, you’re eligible for order cancellation and a full refund. If your order was already fulfilled and you received a tracking number, you MUST wait until the package arrives to start the return process. Consumer Protection Law
Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
BLACKBOX GAMING SYSTEMS PTY LTD and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity except where prohibited by law, by using this Site you indemnify and hold harmless BLACKBOX GAMING SYSTEMS PTY LTD and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
These Terms and Conditions are governed by Australian Consumer Laws.
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
